GENERAL CONDITIONS

1. Applicability of these conditions

By accepting an offer or placing an order, you imply that you accept the applicability of these Conditions.

2. Offers/agreements

2.1 All offers from 'Felithci Cuero' are non-binding, and 'Felithci Cuero' expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations.

2.2 An agreement is only established once your order has been accepted by 'Felithci Cuero'. 'Felithci Cuero' has the right to refuse orders or attach certain conditions to delivery, unless expressly stated otherwise. 'Felithci Cuero' may change the delivery conditions if necessary. In this case, 'Felithci Cuero' will inform you. If an order is not accepted, 'Felithci Cuero' will notify you within ten (10) working days of receiving the order. 'Felithci Cuero' will communicate a reason, but any reason is permitted.

2.3 'Felithci Cuero' has the right to change the content of these General Conditions. Changes will be communicated via the website and will come into force immediately after communication, or on another date specified in the communication.

3. Prices and payments

3.1. The prices indicated for the products and services offered are in euros, including VAT and excluding shipping costs, any taxes or other fees, unless otherwise indicated or agreed in writing.

3.2 Payment can be made as indicated during the ordering process.

4. Delivery

4.1. The delivery times indicated by Felithci Cuero are merely indicative. Exceeding any delivery deadline does not entitle you to compensation, nor does it entitle you to cancel your order or terminate the contract.

4.2. Delivery of the products takes place at the place and time the products are ready for shipment.

5. Liability and retention of title

You are obliged to check, upon delivery, that the products comply with the contract. If they are not, you must inform 'Felithci Cuero' as soon as possible and, in any case, within seven (7) working days of delivery, or after the time at which the finding was reasonably possible, by e-mail and in a reasoned manner. Together with 'Felithci Cuero', you will be able to find a solution to the problem.

6. Intellectual and industrial property rights

You must fully and unconditionally respect all intellectual and industrial property rights relating to the products supplied by 'Felithci Cuero'.

7. Right of Retraction

In the case of distance selling to consumers who fall within the scope of the Law of April 6, 2010, the consumer has the right to inform the seller that they are withdrawing from the purchase, without paying a fine and without giving a reason, within fourteen calendar days of the day following delivery. If the consumer makes use of this option, they must return the goods in their original condition and packaging, at their own risk, to Felithci Cuero, Rua das Fontainhas, N.º 148 3700-115 São João da Madeira, Portugal . Goods specifically designed for the Buyer will not be accepted back, and the Buyer will therefore not be able to invoke the withdrawal clause.

8. Orders/communication

'Felithci Cuero' is not responsible for communication failures, delays or inadequate receipt of orders and communications resulting from the use of the Internet or any other means of communication between you and 'Felithci Cuero', insofar as they relate to the relationship between you and 'Felithci Cuero', unless there is intent or gross negligence on the part of 'Felithci Cuero'.

9. Force Majeure

9.1 'Felithci Cuero' has the right to suspend the execution of your order or terminate the contract without judicial intervention. This will always be communicated to you by e-mail. Felithci Cuero will not have to pay any compensation for this. The amount already paid will be returned to the buyer.

9.2 We are not liable for a delay in performance or non-performance of our obligations due to events beyond our normal control, including production interruptions, supply difficulties or shortages of raw materials, labor, energy or transportation or delays in transportation, strikes, lock-outs, work stoppages or other collective labor disputes, affecting either ourselves or our suppliers, and this even if such events are foreseeable.

10. Miscellaneous

10.1 If you provide Felithci Cuero with an address in writing, Felithci Cuero has the right to send all orders and communications to that address, unless you inform Felithci Cuero by e-mail to which address your orders should be sent.

10.2 If one or more provisions of these Conditions or any other agreement with 'Felithci Cuero' are contrary to any applicable legal provision, the provision in question shall be void and shall be replaced by a new legally permissible and comparable provision to be determined by 'Felithci Cuero'.

10.3 'Felithci Cuero' has the right to use third parties for the execution of its order(s).

11. Applicable law and jurisdiction

11.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are governed exclusively by Portuguese law.

11.2 All disputes between the parties shall be submitted exclusively to the Consumer Conflict Arbitration Centers.

12. Personal Data

When ordering on the website www.felitchicuero.ptBy way of derogation from Article 6, the Buyer expressly consents to the processing and use of his personal data for purposes such as the administration of the customer database, the management of orders, deliveries and invoices, the monitoring of creditworthiness, marketing and advertising. Processing for marketing purposes and individualized advertising only takes place if the customer has expressly agreed to this during the ordering process. Felithci Cuero may not pass on the data to third parties. The Buyer has the right to access and rectify all data. The Purchaser has the right to object free of charge, at any time, to processing for direct marketing purposes. For further information, the Buyer is invited to consult the public register kept by the National Data Protection Commission.

13. Complaints

To be admissible, claims must reach us: (a) in the case of a claim for non-conforming delivery, eight (8) days after delivery and (b) in the case of hidden defects, eight (8) days after discovery of the defect or after the time at which such discovery could reasonably have occurred. Receipt of the goods by the Buyer covers any possible defect or non-conformity that could then be ascertained.

14. Warranty

Our guarantee is limited to the guarantee for hidden defects and the guarantee in the event of sale to consumers, both of which are provided for in the Civil Code. We are only liable for damages resulting from intent or serious fault. We are not liable for general or special indirect damages of any kind suffered by the Buyer.
